Accolade and Cath Kidston clash over Babycham logo

Accolade Wines has issued a High Court writ to homeware company Cath Kidston in order to protect its Babycham mascot.

According to the company Cath Kidston used a "similar" deer image on its Christmas wear range last year, which Accolade feels has infringed copywrite. The Cath Kidston company believes there are no "substantial" similarities between the logos.

The writ seeks injunctions to prevent Catch Kidston from using the image and requests the destruction of all products marked with it.

The official statement from Accolade Wines, said: "Accolade Wines has taken court action against Cath Kidston Ltd to protect its iconic Babycham mascot.

"Accolade Wines considers that the image of a young deer used in the Kidston Christmas homewares range could be confused with the the long-known and trademarked Babycham image. We are most concerned that the use of a similar image risks bringing the brand into disrepute by using alcohol-related imagery on material designed for children. The company's initial attempts to resolve the dispute had been unsuccessful leaving no option other than to go to court."

In response a Cath Kidston spokesperson said: "Cath Kidston Ltd does not believe that there are any substantial similarities between its 2012 Christmas deer image and Babycham's trademark. We have been advised that Babycham's action is without merit. We will fight these claims accordingly. As the matter is being litigated, we can make no further comment at this time."
